2. These terms
2.1 These terms apply to your use of the site and of the free tools and materials on it. By using the site you agree to them. If you do not agree, please do not use the site.
2.2 The free tools and materials are:
(a) the LinkedIn Visibility Score quiz and the Visibility Score Playbook that comes with your result
(b) our articles, the LinkedIn Survival Guide and any guide you can download, such as The Invisible Expert's Field Guide to AI Search
(c) The Bridge, our weekly email newsletter
(d) the free 30-minute Checks (Profile Check, Network Check, Pipeline Check and Content Check) that you can book through the site
[To confirm: this list is complete. Add any other free tool or download, and delete any that is withdrawn]
Together these are the "free tools".
2.3 The site is for businesses and professionals. You must be at least 18 to use it.
2.4 These other documents also apply:
(a) our Privacy and Cookies notice at tdc101.com/privacy/, which explains how we use personal data and the cookies and similar technologies on the site
(b) our Service Terms, which apply if you buy services from us. See section 9. [To confirm: the final name of the document that governs paid services, and the web address where it will be published]
2.5 If you use the site on behalf of a business, you confirm that you have authority to agree to these terms for that business.
3. Using the site
3.1 You may view the site and use the free tools for your own business or professional purposes.
3.2 The site is free to use. We do not promise that the site, or anything on it, will always be available or will work without interruption or error. We may suspend, withdraw or change all or part of the site at any time without notice.
3.3 You are responsible for the device, software and internet connection you use to reach the site.
3.4 We take reasonable care to keep the site secure, but we do not promise that it is free from viruses or other harmful code. You should use your own virus protection.
4. Acceptable use
4.1 You must use the site lawfully. You must not:
(a) use the site in a way that breaks any law or regulation that applies to you
(b) use the site to send or upload anything that is unlawful, defamatory or offensive, or that infringes someone else's rights
(c) give false details, pretend to be someone else, or enter another person's details into a free tool or form without their permission
(d) try to get unauthorised access to the site, the server it is stored on, or any server, computer or database connected to it
(e) knowingly introduce viruses or other harmful code, or attack the site in any way, including by a denial-of-service attack
(f) use any robot, scraper or other automated means to access, copy or extract content or data from the site, or to complete a free tool, without our written permission
(g) use the site or its content to build, train or improve a competing product or service, or to train any artificial intelligence or machine learning model, without our written permission
(h) copy, resell or republish the free tools or our content, except as section 6 allows
(i) interfere with, damage or disrupt the site or anyone else's use of it.
4.2 If you break this section we may stop you using the site, and we may report you to the relevant authorities.
5. Free tools: general information, not advice
5.1 The free tools and the other content on the site give general information only. They are not advice written for you or your business.
5.2 Nothing on the site is legal, financial, tax, investment or other professional advice. You should take your own advice before you act, or decide not to act, on anything on the site.
5.3 The Visibility Score. Your score and result are worked out automatically from the answers you give. They are a general guide to how you use LinkedIn. They are only as accurate as your answers. They are not an audit of your LinkedIn profile or your business, and they are not a forecast of what you will achieve.
5.4 Free Checks. A free 30-minute Check is a general conversation about your LinkedIn presence. Anything we say in a Check is general guidance based on what you tell us and what we can see at the time. It is not a full audit, a quotation or a promise.
5.5 Guides and articles. Our guides and articles share how we approach LinkedIn. LinkedIn changes its rules, limits and features often, and it applies them at its own discretion. You are responsible for how you use your own LinkedIn account and for keeping to LinkedIn's terms.
5.6 No guarantee of results. We do not guarantee that using the site, the free tools or anything you learn from them will produce any particular result. We do not guarantee any number of connections, replies, conversations, meetings or clients, or any revenue.
5.7 Figures and examples on the site. Any figures, examples or client stories on the site describe past work for particular clients in particular circumstances. Where we publish a figure, we say which period and which accounts it comes from. A figure is not a promise that you will get the same result.
5.8 We try to keep the site accurate and up to date. We do not promise that it is complete, accurate or current, and we may change or remove content at any time.
5.9 When you use a free tool you give us personal data. Our Privacy and Cookies notice explains what we do with it, including when we may contact you about your result.
6. Intellectual property
6.1 We own, or have permission to use, all intellectual property rights in the site and its content. This includes the text, graphics, logos, images, video, downloads, the free tools, the questions and scoring in the Visibility Score, and our methods, frameworks, templates and processes, including the "DM Bridge". All rights are reserved.
6.2 "The Digital Collective", "TDC", "Visibility Score", "DM Bridge", "The Bridge" and our logos are our trading names and brands. [To confirm: which, if any, are registered trade marks, with the registration numbers] You must not use them without our written permission, except to refer to us accurately.
6.3 You may:
(a) view the site and use the free tools
(b) download or print our guides and your own Visibility Score result for your own internal business use
(c) share a link to the site, or share a short extract of our content with clear credit to us and a link to the source.
6.4 You must not, without our written permission:
(a) change, sell, license or republish our content
(b) use our content in a product or service you offer to others
(c) remove any copyright or ownership notice
(d) present our content, methods or frameworks as your own.
6.5 If you break this section, your right to use the site ends at once and you must destroy or return any copies you have made.
6.6 The answers and information you give us stay yours. You give us permission to use them to provide the free tools to you and as set out in our Privacy and Cookies notice. If you send us feedback or suggestions about the site, we may use them without any obligation to you.
7. Linking to our site
7.1 You may link to the site if you do it in a way that is fair and legal and does not damage or take advantage of our reputation.
7.2 You must not link in a way that suggests we approve of or endorse you when we do not. You must not frame the site on another site.
7.3 We may withdraw permission to link at any time.
8. Links to third-party sites and services
8.1 The site links to websites and services run by others, such as LinkedIn, YouTube and PayPal. Some tools on the site are provided by others. The Visibility Score runs on ScoreApp. Bookings run on Calendly. The Bridge newsletter runs on Kit. The contact form runs on Formspree.
8.2 We provide these links and tools for your convenience. We do not control third-party sites or services and we are not responsible for their content or their availability. Their own terms and privacy notices also apply when you use them. Our Privacy and Cookies notice explains which of them act for us and which act for themselves.
8.3 We are not affiliated with, sponsored by or endorsed by LinkedIn Corporation. LinkedIn and Sales Navigator are trade marks of LinkedIn Corporation.
9. Buying services from us
9.1 These terms cover the site and the free tools only. They do not cover the services we sell.
9.2 The descriptions of our packages and prices on the site are for information. They are not an offer that you can accept by itself. We may change packages and prices at any time before an order is agreed.
9.3 Prices on the site are in US dollars. [To confirm: whether prices include VAT, exclude VAT, or VAT does not apply, and say which here and next to every price]
9.4 If you buy services from us, the contract between you and us is made up of our separate Service Terms and the order we agree with you. If anything in these terms conflicts with the Service Terms, the Service Terms apply to the services.
9.5 Where the site says "no contract", it means there is no minimum term. There is still a contract for the services. Services are billed monthly in advance through PayPal, and you can cancel at any time. [To confirm: when a cancellation takes effect, for example at the end of the month already paid for, and whether any part of a month is refunded]
9.6 If we offer online checkout on the site, we will show you the Service Terms, the price, how billing works and how to cancel before you pay, and we will confirm your order by email.
9.7 Nothing on the site, in a free tool, or said in a free Check or any other call before you become a client is a guarantee about the services. The only promises we make about the services are those in the Service Terms and the order.
10. Our liability to you
10.1 Nothing in these terms limits or excludes our liability for:
(a) death or personal injury caused by our negligence
(b) fraud or fraudulent misrepresentation
(c) anything else for which the law does not allow us to limit or exclude liability.
10.2 The site and the free tools are provided free of charge and "as is". To the fullest extent the law allows, we exclude all conditions, warranties, representations and other terms that might otherwise be implied by law into these terms or apply to the site or its content.
10.3 Subject to clause 10.1, we are not liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any of the following arising out of or connected with your use of, or inability to use, the site or the free tools, or your reliance on any content on the site:
(a) loss of profit, sales, business or revenue
(b) loss of anticipated savings
(c) loss of business opportunity, goodwill or reputation
(d) business interruption
(e) loss of or damage to data
(f) any restriction, suspension or closure of a LinkedIn account or any other third-party account
(g) any indirect or consequential loss.
10.4 Subject to clause 10.1, our total liability to you arising out of or connected with the site, the free tools and these terms is limited to [To confirm: amount, on the solicitor's advice, or delete this clause and rely on clauses 10.2 and 10.3].
10.5 We are not responsible for events outside our reasonable control.
10.6 If you are a client, our liability for the services is dealt with in the Service Terms and not in this section.
10.7 If, despite clause 2.3, you use the site as a consumer, nothing in these terms affects the legal rights you have as a consumer that cannot be limited or excluded.
11. Changes
11.1 We may change these terms at any time by updating this page. The date at the top shows when they were last updated. Please check this page from time to time. The terms in force when you use the site apply to that use.
11.2 We may update or change the site and the free tools at any time, and we may withdraw a free tool.
12. General
12.1 If a court finds that any part of these terms is not valid or cannot be enforced, the rest still applies.
12.2 If we do not enforce a right under these terms, or delay in doing so, we have not given up that right.
12.3 These terms are between you and us. No one else has any right to enforce them.
12.4 We may transfer our rights and obligations under these terms to another organisation, for example if we sell our business. This will not affect your rights under these terms.
13. Governing law and courts
13.1 These terms, and any dispute or claim arising out of or connected with them or the site, including non-contractual disputes and claims, are governed by the law of England and Wales.
13.2 The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
13.3 We run the site from the United Kingdom. If you use it from another country, you are responsible for following the local laws that apply to you.
14. Contact
14.1 If you have a question about these terms or the site, or want to tell us about content on the site that you think is wrong or unlawful, contact us:

Solicitor notes (remove before publishing)
Prepared as a first draft for review. These are the points that still need a lawyer.
- Liability cap (10.4). No fees are paid for the free tools, so the client cap (three months' fees) does not fit. Please advise on a figure, or on dropping the cap. Section 10 must pass the reasonableness test in the Unfair Contract Terms Act 1977 for business users.
- How visitors accept (2.1). Acceptance by use is weak, especially in the US. We propose a line at each point where a visitor gives details (Visibility Score, newsletter, contact form, booking): "By continuing you agree to our Website Terms of Use and have read our Privacy and Cookies notice." Please confirm the wording.
- Free Checks (2.2(d), 5.4, 9.7). The free 30-minute calls are now inside these terms. Please confirm that suits you, or move them to separate terms.
- "No contract" (9.5). The site says "No contract" and "cancel any time". Clause 9.5 says this means no minimum term. Please check this reads consistently with the Service Terms and with the cancellation and refund position.
- Online checkout (9.6). A PayPal subscription checkout is built but switched off. Before it goes live it needs signed-off Service Terms and pre-contract information. If any buyer could be a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply: Schedule 2 information, the 14-day cancellation right, an express request before services start in the cancellation period, and a pay button that makes the obligation to pay clear (regulation 14). The Electronic Commerce (EC Directive) Regulations 2002 (regulations 9 and 11) also apply to the order steps and acknowledgement. The consumer subscription rules in the Digital Markets, Competition and Consumers Act 2024 are expected from January 2027.
- Business users only (2.3, 10.7). Sole consultants and coaches may sometimes act as consumers. If consumer use is realistic, the liability and jurisdiction clauses need a consumer version (Consumer Rights Act 2015, and an EU consumer's home-country rules).
- Published figures and client stories (5.7). Clause 5.7 only helps if the pages match it. Figures must be accurate, current and capable of substantiation, and testimonials must disclose any material connection (CAP Code rules 3.7 and 3.45 to 3.50, Business Protection from Misleading Marketing Regulations 2008). One quoted "client" is also a reseller partner whose own work was a barter. See the separate compliance report.
- Trading disclosures (section 1). The footer already shows the registered name, number and office. It still needs "Registered in England and Wales" and, if registered, the VAT number (Company, Limited Liability Partnership and Business (Names and Trading Disclosures) Regulations 2015, regulations 24 and 25, Electronic Commerce Regulations 2002, regulation 6). Prices must say whether they include VAT (regulation 6(2)).
- ICO registration. ZA833783 expires on 21 December 2026 and the register shows an old London address and only the name "The Digital Coach". It needs renewing and updating.
- Intellectual property (section 6). Confirm registered marks and that TDC owns or licenses all photos, fonts and video. Consider registering "DM Bridge" and "Visibility Score".
- AI training and scraping (4.1(f) and (g)). This is a contractual restriction only. Consider a technical reservation in robots.txt as well.
- US and EU differences (sections 10 and 13). US courts expect warranty exclusions to be conspicuous and to name merchantability, fitness for purpose and non-infringement. Some EU countries cut down wide exclusions even between businesses. Consider a short US paragraph if US visitors matter.
- Site set-up. The site currently sends /terms and /terms-and-conditions to the privacy page (next.config.ts). Those redirects must be removed when this page goes live at /terms/, and the footer must link to it.
